Terms of Service

PulseDoc is not for medical emergencies. If you think you may be experiencing a medical emergency, call 911 (or your local emergency number) immediately. Do not rely on the app, the PulseBand, or a scheduled consultation in an emergency.

1. Agreement to these terms

These Terms of Service (the “Terms”) govern your use of the PulseDoc mobile app, the PulseBand companion features, and this website (together, the “Service”), operated by Pulse MD Health LLC, a New Jersey limited liability company doing business as PulseDoc.ai (“PulseDoc”, “we”, “us”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What PulseDoc is — and is not

PulseDoc is a technology platform. It lets you record wellness signals from the PulseBand and Apple Health, generate a static, timestamped health-report snapshot, and book scheduled video consultations with independent, licensed clinicians who can review that report with you.

PulseDoc is not a healthcare provider and does not practice medicine. We do not diagnose conditions, prescribe treatment, direct clinical care, or interfere with a clinician’s independent professional judgment.

Clinicians on the platform are independent, licensed professionals. They are not our employees or agents. The professional services you receive are provided by the clinician directly to you, under their own license and their own professional judgment — we provide the technology that connects you, and nothing more. We do not employ clinicians, we do not set or influence their clinical decisions, and we do not take a share of their professional fees.

3. Clinician–patient relationship

  • Any clinical relationship formed through the Service is between you and the clinician you consult — not with PulseDoc. Clinicians on the platform are independent professionals responsible for their own care decisions and record-keeping.
  • A consultation does not by itself create an ongoing treatment relationship, and clinicians may decline, limit, or end a consultation where telehealth is not appropriate.
  • Telehealth has limits. It is not a substitute for in-person care; a clinician may direct you to seek in-person or emergency care, and you should follow that direction.
  • The Service is currently available only in New Jersey. Clinicians on the platform are licensed in New Jersey, and you must be physically located in New Jersey at the time of your consultation. If you are outside New Jersey, a clinician may be unable to consult with you.

4. PulseBand and health features — wellness, not medical

  • The PulseBand and the app’s health features measure, record, and display wellness signals (such as heart rate, sleep, activity, temperature, and blood oxygen) for general wellness purposes.
  • The PulseBand is not a medical device. It is not FDA-cleared or FDA-approved, and it is not intended to diagnose, treat, cure, or prevent any disease or condition, nor to provide continuous or real-time clinical monitoring.
  • The consultation report your clinician reviews is a static, timestamped snapshot that you generate and share — clinicians do not watch your readings live.
  • Readings can be affected by fit, movement, skin condition, and other factors and may be inaccurate or incomplete. Never ignore professional medical advice, or delay seeking it, because of a reading in the app.

5. Eligibility and your account

  • You must be 18 or older to create an account and use the Service. The Service is not available to minors, and you may not use it on another person’s behalf.
  • You agree to provide accurate information — including the health details you share with clinicians — and to keep your sign-in method secure. You are responsible for activity on your account.
  • Clinicians must additionally hold and maintain valid licensure and credentials, and warrant that everything they submit for verification is accurate.

6. Subscriptions, fees, and billing

Your subscription

  • PulseDoc is offered to patients as a monthly subscription at US $19.99 per month. Your subscription includes scheduled video consultations with clinicians on the platform, with no separate per-visit charge, and access to our premium insight features.
  • Viewing your own core metrics from the PulseBand and Apple Health does not require a subscription.
  • Auto-renewal. Your subscription renews automatically each month until you cancel. We will tell you the price and the billing period before you subscribe.
  • If you subscribe through the Apple App Store, Apple bills you and manages your subscription. Cancel or change it in your Apple ID settings — cancellation takes effect at the end of the current billing period, and cancelling does not retroactively refund the period you are in. Refunds for App Store purchases are handled by Apple under its refund policy; we cannot issue them. Request one through Apple Support.
  • Price changes. We may change the subscription price. We will give you notice first, and a change will never apply to a billing period you have already paid for.

Cancelling a consultation

  • Because consultations are included in your subscription, cancelling or missing one costs you nothing. Please cancel as far in advance as you can so the clinician’s time can be offered to someone else.
  • Repeatedly missing booked consultations without cancelling may lead us to limit or suspend your access to booking.

Clinicians

  • Clinicians pay a flat monthly fee to offer consultations on the platform. That fee is for platform access only. It is not tied to the number of patients a clinician sees, and it is not a share of any clinician’s professional fees. We do not pay clinicians for referrals and we do not take a percentage of what they earn.

7. The PulseBand device

  • Purchase. The PulseBand is a physical product sold at US $149.99, plus any applicable sales tax and shipping. It is sold directly by us and charged through Stripe — not through the App Store.
  • Shipping and risk of loss. We ship to the address you give us; you are responsible for its accuracy. Title and risk of loss pass to you when the carrier delivers the device. Delivery estimates are estimates, not guarantees.
  • Returns. You may return an undamaged PulseBand within 30 days of delivery for a refund of the purchase price to your original payment method. Shipping charges are not refundable. Contact us to start a return.
  • Limited warranty. We warrant the PulseBand against defects in materials and workmanship for one year from delivery. If it fails during that period we will repair or replace it, or refund you, at our option. The warranty does not cover accidental damage, misuse, unauthorized modification, water exposure beyond the device’s stated rating, or normal wear of the strap and finish.
  • This warranty is about the hardware working — not about the accuracy of any reading. As stated in section 4, the PulseBand is a consumer wellness device, not a medical device, and nothing in this warranty is a promise of clinical accuracy.
  • Some states give consumers additional rights that cannot be waived; nothing here limits those rights.

8. Acceptable use

You agree not to:

  • use the Service for anyone other than yourself, or impersonate another person;
  • misuse consultations — including abusive conduct toward clinicians or seeking care for unlawful purposes;
  • probe, scrape, reverse-engineer, or interfere with the Service or its security controls;
  • upload content you have no right to share, or use the Service in violation of any law.

9. Your data and our license

You own your data. You grant us the limited license needed to host, process, and display it in order to run the Service — including preparing your consultation report and sharing it with the clinician you book. How we handle your information is described in the Privacy Policy.

The Service itself — software, design, and content we provide — is ours or our licensors’, and we grant you a personal, non-exclusive, non-transferable license to use it as intended.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy of readings, and uninterrupted availability. Health information in the app is for general wellness and informational purposes and is not medical advice from PulseDoc.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for the acts or omissions of independent clinicians. Our total liability for all claims relating to the Service is capped at the greater of (a) the amounts you paid us in the twelve months before the claim arose, or (b) US $100. Nothing in these Terms limits liability that cannot be limited by law — including liability for gross negligence, willful misconduct, or personal injury. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

You can stop using the Service and delete your account in-app at any time. Deleting your account does not by itself cancel a subscription billed by Apple — cancel that in your Apple ID settings. We may suspend or terminate accounts that violate these Terms or put the Service or other users at risk. Sections that by their nature should survive termination (including 9–12) survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute arising out of or relating to the Service or these Terms will be resolved exclusively in the state or federal courts located in New Jersey, and you and we each consent to the personal jurisdiction of those courts. There is no arbitration requirement and no class-action waiver in these Terms.

15. Changes to these terms

We may update these Terms as the Service evolves. We will update the date at the top and, for material changes, notify you in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.
